Terms of Use

These Terms of Use ("Terms") are an agreement between you and Monsoro, LLC, a South Carolina limited liability company ("Monsoro," "we," "us"), which operates Adaptable: the iPhone and Android apps, the adaptable.cooking website, and related services (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use Adaptable

You must be old enough to agree to these Terms where you live. You must be at least 13 years old (or older if your country requires it).

2. Your account

Give accurate information and keep your login secure. You're responsible for activity on your account. You can sign up with email, Sign in with Apple, or Google Sign-In. Your use of those sign-in services is also governed by Apple's or Google's terms.

You can delete your account at any time in the app (iPhone: Profile → Delete account; Android: You → Delete account). See the Privacy Policy for what we remove. Deleting the account does not cancel a store subscription.

3. Adaptable Plus subscriptions

• What it is. Adaptable Plus is an optional auto-renewing subscription that removes or raises limits on AI features (such as generating, importing, adapting, and fridge-photo reading). Features may change over time.
• Price and billing period. The plans available to you, their price, billing period, and any free trial or introductory offer are shown in the app and by the App Store or Google Play before you confirm the purchase. Prices may vary by country and may change. We'll give notice of price changes as Apple or Google require. These Terms do not name a price or a trial length.
• Billing. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. Purchases are processed by Apple or Google, not by Monsoro, and are managed with the help of our subscription provider, RevenueCat.
• Auto-renewal. Your subscription renews automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within the 24 hours before the period ends.
• Free trials. If a free trial is offered and you're eligible, you won't be charged until it ends unless you cancel at least 24 hours before it ends. Eligibility is decided by Apple or Google (for example, one trial per account). Any unused part of a free trial is forfeited when you buy a subscription.
• How to manage or cancel. Cancel anytime in Settings → [your name] → Subscriptions on iPhone, or in Google Play → Payments & subscriptions → Subscriptions on Android. Cancelling stops future renewals. You keep Plus until the end of the period you've already paid for. Deleting the app or your Adaptable account does not cancel the subscription.
• Refunds. Store purchases follow Apple's refund process (reportaproblem.apple.com) and Google's Play refund policies. Monsoro cannot issue a store refund directly. There are no prorated refunds except where the law requires them. Goodwill refunds, when we can make them, are at our discretion. Email support@monsoro.co to ask.
• Restore. Use "Restore purchases" in the app to reconnect an active subscription on the same store account.

4. Your content

You keep ownership of the recipes, comments, photos, and other content you submit. You give Monsoro a worldwide, non-exclusive, royalty-free license to host, store, process (including with AI providers as described in the Privacy Policy), display, and share that content as needed to run the Service, including on public recipe pages and in shared links. You confirm you have the right to submit what you upload. We may remove content that breaks these Terms or our Community guidelines.

5. AI-generated recipes, food safety, and allergies

Recipes and suggestions produced with AI can be wrong, incomplete, or unsuitable for your kitchen. They aren't medical, nutritional, or dietetic advice. Allergy and diet filters are best-effort, not a guarantee: they can miss ingredients, cross-contact, or regional names. If you have a severe allergy or medical dietary need, read every ingredient yourself and follow a qualified professional's advice. You're responsible for how you cook, store, and serve food.

6. Acceptable use

Don't post illegal, harassing, hateful, sexual, or infringing content. Don't post someone else's private information. Don't scrape, overload, reverse-engineer, or bypass usage limits or security. Don't resell or misuse AI features, or use the Service to produce content unrelated to cooking that breaks these Terms.

7. Our intellectual property

The Service, including the apps, design, and Adaptable brand, belongs to Monsoro and its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the apps on devices you own or control, under these Terms and the applicable store rules.

8. Apple App Store terms (iOS)

If you got Adaptable from the Apple App Store, your license to use the iOS app is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"). If these Terms conflict with the Standard EULA about the iOS app license, the Standard EULA controls for that conflict. These Terms govern everything else, including subscriptions, content, and acceptable use.

These Terms are between you and Monsoro, not Apple. Apple isn't responsible for the app or its content, and has no obligation to provide maintenance or support. If the app fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation.

Apple isn't responsible for product claims, legal or regulatory claims, consumer-protection claims, or intellectual-property claims relating to the app. Monsoro is responsible for those to the extent these Terms require.

You confirm you aren't located in a country subject to a US government embargo and aren't on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

While our Apple developer account transitions to Monsoro, LLC, the App Store may list Ken Mills, Monsoro's founder, as the seller. Monsoro, LLC is the operator and the party to these Terms.

9. Google Play terms (Android)

If you got Adaptable from Google Play, your purchase and use are also subject to the Google Play Terms of Service. Google isn't a party to these Terms and isn't responsible for the app.

10. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms, if we need to protect users or the Service, or if we discontinue the Service. Sections that should survive (content licenses needed to finish removing content, disclaimers, limits of liability, and governing law) will survive.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, Monsoro disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, error-free, or that AI output will be accurate.

12. Limitation of liability

To the fullest extent the law allows, Monsoro won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid for Adaptable Plus in the 12 months before the claim, or (b) US $50. Some places don't allow these limits, so they may not apply to you.

13. Indemnity

You agree to defend and indemnify Monsoro against claims arising from content you submit or your breach of these Terms, to the extent the law allows.

14. Governing law and disputes

These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in York County, South Carolina, and you and Monsoro consent to their jurisdiction, unless the law where you live gives you the right to bring a claim locally. Before filing a claim, please email support@monsoro.co so we can try to resolve it informally.

15. Changes to these Terms

We may update these Terms. If a change is material, we'll update the version and the dates at the top and notify you in the app or by email before it takes effect. If you keep using the Service after the change, you accept the new Terms.

16. General

These Terms, together with the Privacy Policy, the Community guidelines, and any applicable store terms (including Apple's Standard EULA for the iOS app), are the whole agreement between you and Monsoro about the Service. If any part is unenforceable, the rest stays in effect. Our failure to enforce a term isn't a waiver. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
